Hate crimes can be considered to be the most severe form of discrimination. This also means that hate crimes can be based on all the grounds on which discrimination occurs. It is important to be well informed about these grounds to properly identify hate crimes.

When a hate crime is committed, the perpetrator has chosen the victim because of certain characteristics possessed bythe victim. SlovenianCriminal Code does not contain a certain hate crime or its’ definition, but it contains certain offences that would fall under the heading of hate crimes. These are, for example, murder for reasons of violation of equality (Art. 16 of the CC-1); the general crime of violation of equality (Art. 131), which punishes the perpetrator who deprives someone of a human right because of his or her personal circumstances; torture (Art. 135a); violations of labour and social rights for discriminatory reasons (Art. 197, Art. 202) and incitement to hatred (Art. 297). For all other offences, however, the discriminatory motive may be taken into account as an aggravating circumstance in sentencing.
