Slovenian law considers the situation to be an minor offence where the offense is less serious than a crime. Hate crimes may also take the form of an administrative offence.

Aggravating circumstances

In Slovenia, the  Protection of Public Order Act Law on Administrative Liability establishes that administrative offences  of violent and insolent behaviour, indecent behaviour, defacing an official inscription, sign or decision, writing on buildings or defacing national symbols, if committed with the intent to incite national, racial, sexual, gender, gender-based, ethnic, religious, political or sexual intolerance, shall be sanctioned more severely. This means that due to the committed hate crime, the person is charged with a minor offense, but during the trial the court should take into account the aggravating circumstances, namely, the bias motive, when adopting the decision.
