You must submit your application in writing.

Form

Your application must be submitted in writing, but you do not need to fill in any specific form.

Language

The working language of the Constitutional Court is Slovenian. All documents have to be submitted in either Slovenian or together with an official translation of the document into Slovenian. If you are an alien and are deprived of your liberty in Slovenia, you can submit a complaint in your own language.

The Court will not provide you with an interpreter during the proceedings. If you don’t speak or understand Slovenian and you need an interpreter, you have to arrange for the interpreter yourself and pay for his services.

Content

In your application you need to clearly indicate:

  • your name and address (the name and the address of the applicant)
  • the name and address of your attorney (if you have one)

and in case that you are petitioning to initiate the procedure for review of the constitutionality or legality of regulations:

  • the legal provision about which you are complaining
     
  • the name of the institution which has issued this law or regulation (e.g., for all laws, it will be the National Assembly of Slovenia)
  • the number of the Official Gazette of the Republic of Slovenia or another official gazette in which the challenged regulation was published
  • the reasons justifying a legal interest in bringing an action
  • legal arguments supporting your claim that your rights have been violated
  • what you are asking the Constitutional Court to declare

or if you are complaining against an individual act by which a state authority violated your human rights:

  • the individual act challenged, an indication of the authority which issued it, its reference number and the date of issue
  • which of your human rights you think were violated
  • legal arguments supporting your claim that your rights have been violated
  • the date on which the contested individual act was served to you
  • the exhaustion of legal remedies (together with an indication of all decisions issued in connection with the subject of the constitutional complaint)
  • what you are asking the Constitutional Court to declare

Try to write about the facts and issues which are related to the violation you are complaining about only. To help the Constitutional Court better understand the situation, try to keep the text simple, focused, well-reasoned and avoid emotional or derogatory language.

Documents

You have to add all the documents related to the situation you are complaining about to your application (especially the complaints you have made thus far and the responses you received).

Time limits

The petition to initiate the procedure for review of the constitutionality or legality of regulations must be sent within 1 year after the legal provision entered into force or within 1 year after you have learned of the violation by the legal provision in question.

The constitutional complaint must be sent within 60 days from the date the individual act in question was served.

Legal aid

If you need a lawyer to help you prepare your application or to represent you in the court and you do not have the funds to pay for the legal services, you may be entitled to free legal aid.
